The Charities Bureau of the Office of the Attorney General of the State of New York participated in the settlement negotiations and approved the terms of the settlement agreement. In connection therewith, the Foundation requested and received approval from the New York State Department of Financial Services for a special permit to issue said charitable gift annuities, which approval is limited to the issuance of these particular charitable gift annuities. As required by the New York State Department of Financial Services, the Foundation maintains a mandated reserve of $1,640,541 as of December 31, 2023, for the surviving annuitants of which there are two remaining. The Foundation filed its 2023 annual statement of the segregated gift annuity fund with the New York State Department of Financial Services, as required by law. The annual annuity payments (total $97,985 per year) are payable to the surviving Annuitants for life. The Annuitants are not related to the Foundation or to any of the managers or directors of the Foundation.
