However, Optica is required to report unrelated business income to the Internal Revenue Service, the District of Columbia, the states of New York and California. In addition, the Internal Revenue Service has determined that Optica is not a private foundation as defined in Section 509(a) of the Internal Revenue Code. Optica's source of unrelated business income consists of advertising income. No provision for income taxes has been made at December 31, 2020 and 2019 as expenses offset taxable income. Optica follows guidance in ASC 740-10 "Accounting for Uncertainty in Income Taxes," whereby an organization must recognize the tax benefit associated with tax positions taken for tax return purposes when it is more likely than not that the position will be sustained. Optica does not believe there are any material uncertain tax positions and accordingly, will not recognize any liability for unrecognized tax benefits. Optica has filed Internal Revenue Service Form 990 tax returns as required and all applicable returns in those jurisdictions where they are required. Optica believes that they are no longer subject to U.S. federal, state, and local or non-U.S. income tax examinations by tax authorities from fiscal year 2015 and earlier. However, Optica is still open to examination by the tax authorities from fiscal year 2016 and forward. For the years ended December 31, 2020 and 2019, there was no interest or penalties recorded in the consolidating statements of activities related to unrecognized tax benefits.
