Part X, Line 2: The College is organized as a Nevada nonprofit corporation and has been recognized by the Internal Revenue Service (IRS) as exempt from federal income taxes under Section 501(a) of the Internal Revenue Code as an organization described in Section 501(c)(3), qualifies for the charitable contribution deduction under Sections 170(b)(1)(A)(vi) and (viii), and has been determined not to be a private foundation under Section 509(a)(1) and (3), respectively. The College is annually required to file a Return of Organization Exempt from Income Tax (Form 990) with the IRS. In addition, the College is subject to income tax on net income that is derived from business activities that are unrelated to its exempt purpose. The College has determined that it is not subject to unrelated business income tax for the years ended June 30, 2019 and 2018; and as such, has not filed an Exempt Organization Business Income Tax Return (Form 990-T) with the IRS for these fiscal years. The College believes that it has appropriate support for any tax positions taken affecting its annual filing requirements, and as such, does not have any uncertain tax positions that are material to the financial statements. The College would recognize future accrued interest and penalties related to unrecognized tax benefits and liabilities in income tax expense if such interest and penalties are incurred. The house was a gift to the College to be used for entertainment by the President. There are no costs associated with this house. The President's spouse accompanies the president for College meetings and athletic events. Per initial employment agreement, the President is provided a residence near the College campus. Personal services include grounds keeping and maintenance and repairs of the residence, but does not include maid service, chauffeur or chef. As residence adjacent to campus is required in employment contract, housing is not included in taxable compensation for the current President.
