We primarily represent clients before the Social Security Administration (SSA) for SSDI & SSI benefits in post-entitlement and continued eligibility for benefits. We hold clinics for beneficiaries of SSDI and/or SSI who have mental and/or developmental disabilities and have issues due to SSDI Work Reviews and SSI redeterminations based on income, and resulting overpayments in either program. After 6 years of litigation, in 2012, PWDF received favorable outcomes on our two federal district court cases filed against the SSA alleging that they discriminate against people with mental (schizophrenia) and developmental (autism) disabilities. (Case Nos. 3:06-CV-6108 EMC (NC) and 3:09-CV-980 EMC (NC).) We believe this is the first time the SSA has offered reasonable accommodations on the basis of mental/developmental disabilities. We are currently in the enforcement stage, ensuring the SSA is not in violation of this settlement agreement. PWDF continues its public awareness and education activities through outreach events, guest speaking, an e-newsletter, informational seminars and training sessions. In 2015, we began increasing our work in submitting public comments to governmental agencies advocating for policies and regulatory changes as they pertain to people with psychiatric and/or developmental disabilities, because this population is too often underrepresented and stigmatized. For example, we submitted comments on Notices of Proposed Rulemakings to the SSA related to disability adjudication and to its work incentive programs and to the US Department of Education related to ensuring their regulations did not result in disabled persons Social Security disability and health care benefits being put at risk. We submitted public comments to the US Department of Labor, Office of Disability Employment Policys Advisory Committee on Increasing Competitive Integrated Employment for Individuals with Disabilities and to the SSA urging them to provide program mechanisms and staff training to ensure that individuals with psychiatric and/or developmental disabilities receive the support frameworks they need in order to engage in sustained competitive integrated employment and to ensure such mechanisms do not jeopardize Social Security disability benefits or dilute Social Security work incentive rules. We also held a free 3-hour public awareness seminar relating to reasonable accommodations in housing for people with psychiatric and/or developmental disabilities. In addition, PWDF continues to market our training videos for distribution. We provide training on the Americans with Disabilities Act (ADA) and SSDI/SSI for people with mental and/or developmental disabilities statewide and locally, including for organizations such as NAMI California, NAMI San Francisco Chapter, the Bar Association of San Francisco, and Support for Families of Children with Disabilities, among others. PWDF also presented as a guest speaker for SWISH and People First.This fiscal year, we received recommendations from a Capstone team of graduate students from the New York Universitys Robert F. Wagner Graduate School of Public Service on expanding PWDFs Public Awareness and Education Program from a primarily local program to national through the use of technology. We had been making many of our events available nationally via live stream, but we asked for recommendations for further expansion. Based on their recommendations, PWDF has hired a Program Coordinator for Technology to make our media resources available to a larger audience, including by making them available in a digital format, and is excited about implementing the Capstone teams recommendations. PWDF has been updating and developing resources related to autism spectrum disorder (ASD). PWDF has served this population through both our Advocacy Program and the Public Awareness and Education Program. For example, one of the plaintiffs we represented in the cases against the SSA mentioned in line 4a has communication impairments related to his ASD and other disorders that were a key reason for his lawsuit. In 2012, our Public Awareness and Education Program held a free, 3-hour public awareness seminar entitled, Autism and Technology: Resources and Opportunities for Transitional Age Youth. In 2016, we updated this work by researching current issues, submitting public comments to the United States Interagency Autism Coordinating Committee (IACC), expanding our network of professionals with expertise in ASD, and holding another public awareness seminar related to ASD. Our public comments to the IACC comprised several recommendations for their 2016 Strategic Plan for Autism Disorder Research. Our comments focused on identifying the needs of adults with autism, particularly when it comes to diagnosis, treatment, and services, including for employment, housing, health care and education. We also addressed core issues such as increasing research to overcome disparities among gender, ethnicity, and income levels. PWDFs 16th free public awareness seminar was on the topic of Adults with Autism; a panel of experts presented information on challenges and resources available to adults with ASD navigating institutions and services. The seminar focused on assessment and diagnosis of adults with ASD, treatments available for adults with ASD, qualifying for California Regional Center Benefits as an adult, and Supplemental Security Income (SSI). This seminar continued the work of our 2012 seminar on autism and technology.
