Under the facts and circumstances test: (1) the Foundation maintains a continuous and bona fide program for soliciting funds from the public and membership groups, and (2) the sources of support provide services directly for the benefit of the general public on a continuing basis. The Foundation's fundraising is conducted by direct contact with potential donors. It is carried out under the supervision of the Society's staff or volunteers of the organization.
