HOWEVER, THE PLAN ADMINISTRATOR, HAVING CONSULTED WITH THE PLAN'S LEGAL COUNSEL, BELIEVES THAT THE TRUST REMAINS TAX EXEMPT AS OF THE FINANCIAL STATEMENT DATE. US GAAP REQUIRES PLAN ADMINISTRATOR TO EVALUATE TAX POSITIONS TAKEN BY THE PLAN. THE FINANCIAL STATEMENT EFFECTS OF AN UNCERTAIN TAX POSITION ARE RECOGNIZED WHEN THE POSITION IS MORE LIKELY THAN NOT, BASED ON THE TECHNICAL MERITS, TO BE SUSTAINED UPON EXAMINATION BY TAXING JURISDICTIONS.
