| Explanation | To Whom It May Concern: I am requesting a waiver of fees for late filing as I believe our request for an extension to May 15, 2011 was denied inappropriately. - The following explains my position: I received your letter denying an extension of our filing date for Form 990 to May 15, 2011. I did not understand the reasoning for the denial letter as we had filed in exactly the same manner the previous year and had received an extension without any problem. The extension was filed in a timely fashion and received by the IRS well before February 15, 2011 (the end of the automatic extension period). - I called the IRS assistance line and spoke with a Miss Atkins. Miss Atkins looked over the extension request and compared it to the prior year's extension request. After her review, Miss Atkins told me the denial letter was sent to us in error and that I should have received an approval letter instead. Miss Atkins told me to ask for a waiver of the denial and all associated fees as this was an obvious error. - I would like to thank Miss Atkins for her thoroughness in reviewing my document and advising me on how to respond.
